HyperMabs places great importance on the protection of Personal Information.
In order to bring to Your attention the privacy practices implemented in connection with its Website, HyperMabs has developed this Privacy Policy, which summarizes: (i) the types of Personal Information collected and the situations that may lead to its collection; (ii) the ways in which Personal Information is used and protected; (iii) the situations in which Personal Information may be shared; and (iv) how Personal Information is stored and destroyed. This policy also describes Your rights, as well as the security measures in place and the procedure applicable in the event of a breach of confidentiality.
HyperMabs would like to point out that You are not required to provide any Personal Information to access and use the Website unless You choose to contact HyperMabs and provide information.
This policy does not apply to Personal Information collected and processed as part of a clinical study, which is not collected and processed through this Website.
1. DEFINITIONS AND INTERPRETATION
Capitalized terms used in this policy have the following meanings:
- HyperMabs refers to HyperMabs Inc.
- Personal Information refers to information about a physical person that directly or indirectly allows that person to be identified.
- Website refers to the https://hypermabs.com website.
- Authorized Subcontractor refers to any person who assists HyperMabs in the development or provision of the Website and who needs to know certain data (including Personal Information) in order to do so.
- User or You refers to any person who accesses or uses the Website, including any member of the public.
Unless the context otherwise requires, grammatical variations of any defined term have the same meaning.
2. GENERAL PRINCIPLES
Personal Information collected or provided in connection with the Website is obtained, used, disclosed, retained and destroyed in accordance with this policy. HyperMabsmay also process such information in accordance with applicable laws and regulations, including the Act respecting the protection of personal information in the private sector, in order to fulfill its responsibilities, including those of protecting the public and monitoring and controlling the profession.
3. COLLECTION AND USE OF PERSONNAL INFORMATION
3.1 Information provided by users
No collection of Personal Information is required to enable You to access and use the Website. You may, however, choose to provide Personal Information to HyperMabs.
In accordance with the law, HyperMabs assumes that if You provide information to HyperMabs, You have consented to the collection of that information by HyperMabs for the purposes for which it is collected (or as otherwise required or permitted by law). If You refuse to provide necessary information, HyperMabs may not be able to provide access to the Website.
The following information may be provided by Users:
- Comments, questions and requests for information: You may choose to provide certain Personal Information (e.g., Your name and e-mail, and Your opinion/observation) if You contact HyperMabs to obtain information or make comments or requests. HyperMabs will use this Personal Information to respond to Your communication.
- Content: You do not need to provide any Personal Information to view the content of the Website. Cookies may, however, collect certain information as described in section 3.2 below.
- Employment: If You wish to submit Your application, HyperMabs will collect Your contact information, as well as the information provided by You (for example, Your resume and Your qualifications) in order to analyze the file and communicate with You.
- Newsletters: If You wish to subscribe to newsletters, then You may do so by providing Your last name(s), first name(s) and e-mail address. HyperMabs will then send You its newsletters in accordance with applicable laws, including the Canada’s anti-spam legislation.
3.2 Information obtained from third parties or through technologies
Certain types of Personal Information may be obtained from third parties or through technologies in the following situations:
- Cookies and other technologies. When You access or use the Website, certain information (e.g., clicks/interactions) may be collected using the following cookies:
Process/utility cookie | These cookies enable the Website to function properly, web pages to maintain their integrity and Users to interact with Website features. |

Cookies are small pieces of text that are placed on devices’ browsers when You access or use the Website.
Other forms of technology may be used for the same purpose. IP addresses are not collected and HyperMabs makes no other attempt to identify You. Cookies and other technologies that are not required (e.g., analysis cookies) can be blocked without impacting the Website. Blocking required cookies (e.g. process/utility cookies) may affect the Website. These technologies and cookies are temporary in nature and will disappear once the browser (or device) is closed. - Social media:HyperMabs uses social media platforms, which allow You to follow it and add it to Your contact list. HyperMabs has access to the web pages and profiles according to the settings chosen, as described in the privacy policies and terms of use applicable to these platforms. HyperMabs also receives notification and access to links and/or other publications in which it is identified. You should review the privacy settings applicable to their accounts/pages in order to validate the information to which their contacts have access and to limit this access, if necessary.
4. USES
HyperMabs uses Personal Information only for the purposes described in Section 3.1 or Section 3.2, as applicable, or as permitted or required by law or with Your consent.
5. Communications
HyperMabs does not sell or otherwise market Personal Information. In addition, Personal Information is not shared/communicated to third parties or used for purposes other than those: (i) described in this policy; (ii) required or permitted by law; or (iii) authorized by the individuals concerned.
- Website: Personal Information may be shared with Authorized Subcontractors who assist HyperMabs in operating the Website. Disclosure will be limited to Authorized Subcontractors who have a need to know and who are bound by confidentiality undertakings, and will take place in compliance with the law;
- Other: Personal Information may be disclosed by HyperMabs acting reasonably, if HyperMabs believes that disclosure is: (i) necessary to comply with applicable law, including legal process or governmental request; (ii) necessary to protect its rights; or (iii) otherwise permitted or required by law.
6. RETENTION
HyperMabs limits the length of time it retains Personal Information and destroys it as soon as possible in a confidential manner.
HyperMabs retains Personal Information only as long as necessary for the fulfillment of the purposes for which it was collected, including: (i) in connection with the Website; (ii) to comply with the law or to prevent violations of the law; (iii) to resolve disputes; and (iv) to ensure the implementation of this policy. When Personal Information is no longer required, it will be destroyed. HyperMabs has established a retention procedure, which includes a retention schedule, and makes reasonable efforts to comply with it.
HyperMabs is a Quebec company, and operates in Quebec, using servers and infrastructure located in Quebec. However, in order to operate the Website, HyperMabs may do business with Authorized Subcontractors who may be located outside Quebec. Thus, any processing of Personal Information carried out by such Authorized Subcontractor may be done in another Canadian province and in the United States, for the purposes described in this policy. Please note that the privacy laws of these jurisdictions may differ from Canadian and Quebec privacy laws. The reasonable measures, contractual or otherwise, that HyperMabs may take to protect Your Personal Information while it is being processed or handled by such Subcontractors are subject to applicable foreign legal requirements, including lawful requirements to disclose Personal Information to government and law enforcement authorities, in certain circumstances. By providing Your Personal Information in connection with the use of the Website, You consent to such transfer and hosting.

7. SAFETY
7.1 Security measures
HyperMabs has implemented various measures to ensure the protection of Personal Information, which are reasonable in light of, among other things, the sensitivity of the information, the purpose for which it is to be used, its quantity, distribution and medium. These measures include the following:
- Limiting Collection and Processing: HyperMabs does not request that Personal Information be provided unless it is required to perform the services requested, and HyperMabs does not collect or process Personal Information other than as described in this policy or as required by law.
- Limited Access: Subject to applicable laws, access to any Personal Information is granted only to those HyperMabs employees and representatives (and, where applicable, Authorized Subcontractors) with a need to know, following the implementation of appropriate measures, and in accordance with applicable laws. These persons are made aware of the importance of maintaining the confidentiality of Personal Information.
- Authorized Subcontractors: Authorized Subcontractors are contractually bound to ensure the protection of Personal Information to which they have access in the performance of their duties and must comply with applicable laws.
- Privacy Impact Assessments: Privacy Impact Assessments are conducted when required by law.
- Security in transit: When Personal Information is communicated to HyperMabs, an HTTPS or reCAPTCHA protocol is used to transfer the information, and Secure Sockets Layer (SSL) technology protects Personal Information using server authentication and data encryption. Activation of this technology can be confirmed by looking at: (i) the browser bar, which will then display, depending on the browser, a padlock to the left of the Website address (URL); and (ii) the URL or browser address bar, in which the first characters should change from “http” to “https”.
- Secure data centers: The Website is hosted on a secure, private platform provided by a reputable IT provider.
- Privacy Incident: If HyperMabs has reason to believe that a privacy incident involving Personal Information has occurred, then HyperMabs will take reasonable steps to minimize the risk of harm and to avoid future incidents. If the incident presents a risk of serious harm, HyperMabs will notify the Commission d’accès à l’information and the individuals concerned. HyperMabs may also notify any person who may be able to reduce this risk (by communicating only the Personal Information required). Finally, HyperMabs will comply with all other legal requirements.
7.2 Limitations
ANY TECHNOLOGY – AS WELL AS ANY OTHER SERVICE/PLATFORM OR METHOD OF DELIVERY – IS NEVER INFALLIBLE OR FULLY PROTECTED AGAINST UNFORESEEABLE EVENTS, CYBER-ATTACKS (AND OTHER ILLEGAL ACTS) OR FAILURES, AND USERS SHOULD BE AWARE THAT THERE IS A RISK ASSOCIATED WITH ANY TRANSMISSION (INCLUDING ELECTRONIC TRANSMISSION) OF DATA. HYPERMABS THEREFORE CANNOT GUARANTEE THAT SUCH DATA (INCLUDING PERSONAL INFORMATION) WILL NEVER BE INTERCEPTED OR SUBJECT TO OTHER INCIDENTS. FURTHERMORE, EVENTS AFFECTING DEVICES AND SYSTEMS (INCLUDING THOSE LEADING TO THEIR ACCESS AND CONTROL) MAY OCCUR, AND UNWANTED COMMUNICATIONS AND INVITATIONS MAY BE RECEIVED. IF USERS RECEIVE ANY COMMUNICATION THAT APPEARS TO BE FROM HYPERMABS REQUESTING FINANCIAL OR OTHER PERSONAL INFORMATION, THEN SUCH USERS SHOULD REFRAIN FROM RESPONDING TO SUCH COMMUNICATION. HYPERMABS WILL NEVER REQUEST FINANCIAL OR OTHER INFORMATION IN THIS MANNER. USERS WHO HAVE PROVIDED PERSONAL INFORMATION IN RESPONSE TO A SUSPICIOUS COMMUNICATION, POP-UP OR WEBSITE CLAIMING TO BE AFFILIATED WITH HYPERMABS OR WHO HAVE EXPERIENCED ANY OF THE EVENTS DESCRIBED ABOVE SHOULD CONTACT HYPERMABS IMMEDIATELY at THE FOLLOWING ADDRESS: privacy@hypermabs.com.
It is also the responsibility of each individual to take measures reasonably required to protect his or her Personal Information.
8. RIGHTS AND COMMUNICATION WITH HYPERMABS
8.1 Rights of Users
Subject to applicable laws, HyperMabs will confirm the existence of any Personal Information it holds about You (or about a third party if permitted by law) following receipt of Your request to that effect, and will provide access to such Personal Information (e.g., by allowing You to take a copy). Subject to applicable laws, You may make requests for correction or exercise any other rights, as applicable, by contacting HyperMabs at the following address: privacy@hypermabs.com and complying with applicable legal requirements.
Before responding to a request, HyperMabs may request information to confirm Your identity.
In some cases, laws may permit or require HyperMabs to refuse to comply with a request. Similarly, information will be inaccessible once it has been destroyed in accordance with HyperMabs’ practices (see Section 6). If HyperMabs is unable to fulfill a request, HyperMabs will inform You of the reasons, subject to any applicable legal restrictions.
8.2 Communicating with HyperMabs
You can contact HyperMabs for:
- questions, comments and requests: Contact information for the Privacy Officer is available bellow. Requests and inquiries will be dealt with promptly and within the applicable legal time limits.
You may refuse or withdraw Your consent to the collection or other processing of Personal Information or request the deletion thereof at any time (subject to reasonable notice) and subject to any legal requirements. However, if consent is refused or withdrawn, HyperMabs may not be able to provide access to all aspects of the Website. The impact of Your decision will be explained to You by HyperMabs upon receipt of Your request.
- any complaint: Contact information for the Privacy Officer is available bellow. You must indicate Your name, the type of complaint and any details deemed relevant in connection with the complaint. The Privacy Officer will send an acknowledgement of receipt, and then proceed to investigate the complaint. If necessary, the Privacy Officer will contact You to obtain any further information required, if applicable. Following the investigation, You will be notified of the outcome. You may also contact the Commission d’accès à l’information; in such a case, the complaint must be made in writing in accordance with the applicable process (see in particular the information available here).
- to unsubscribe from emails: This can be done at any time by using the contact information of the Privacy Officer available bellow, or by clicking on the unsubscribe mechanism at the bottom of each email or by replying to an email received with the word “Stop” or “Unsubscribe”.
9. THIRD-PARTY WEBSITES
The Website may contain hyperlinks to third-party websites. HyperMabs is not the owner of and is not responsible for these websites. HyperMabs does not control the content or functionality of these third-party websites. Accordingly, HyperMabs does not accept any responsibility for such websites. You should consult the privacy policies of these other websites before using them.
10. OTHER
10.1 Changes:
This policy may be revised from time to time. Such changes will be made available in the manner prescribed by law. If You do not agree to such changes, You must cease accessing and using the Website before such changes become effective; thereafter, all access and use shall constitute acceptance of such amendments.
10.2 Severability:
If any provision in this policy is in conflict with any law or is unenforceable, then such provision shall be severable from the remaining provisions and deemed rewritten so as to be valid and enforceable while preserving, to the fullest extent possible, its original intent.
10.3 Force majeure:
HyperMabs shall not be liable for any damages caused by any force majeure situation.
10.4 Applicable laws:
This policy is governed by the laws in force in Quebec to the exclusion of any principle or rule that may lead to the application of foreign laws. Any dispute which cannot be resolved by direct negotiation in good faith shall be submitted to the courts of the Province of Quebec, which shall have exclusive jurisdiction to settle such dispute.
